GDPR information to job applicants

Thank you for taking an interest in VOLA, applying for a job with us.

In connection with the VOLA Group's ("VOLA") recruitment procedures, we process your personal data as laid down in this policy. The VOLA company with which you apply for a job is the data controller in the processing of the personal data collected in connection with our recruitment procedure.

Consequently, we are under an obligation to provide you with information on our processing of your personal data.

We collect and process the personal data appearing from your application and your CV as well as any attachments with a view to evaluating your application. If you are invited to an interview, we will collect and evaluate the data you provide in that connection. The legal basis for our processing of your personal data is your application for the conclusion of an employment contract with VOLA, see Article 6(1)(b) of the General Data Protection Regulation (GDPR), as well as our legitimate interest in processing the personal data provided to us by you, cf. Article 6(1)(f) of the GDPR.

In addition, we may search the Internet for relevant and available information, including social media contents. We will typically look for information on your previous employments, activities, qualifications, performance as well as your general appearance.

If the job in question requires you to complete personality tests or the like, you will be informed thereof when we have processed your application. The results of such tests will be kept confidential, but will be included in our evaluation of your application. Unless you are hired, the results will be deleted as soon as the evaluation has been completed. The legal basis for this processing is Article 6(1)(b) of the GDPR.

In certain circumstances, you may also be requested to submit a copy of your criminal record depending on the job in question. Such personal data will also be kept confidential. In such cases, we will ask for your consent to the processing of the personal data, cf. Article 6(1)(a) of the GDPR.

As part of our evaluation of you and your application, we may wish to obtain references from your former and/or current employers. We will obtain references only from persons whose names you have stated in your application. The legal basis for the processing is Article 6(1)(f) of the GDPR or, if you have consented to the processing in question, Article 6(1)(a) of the GDPR.

We recommend that your application not contain sensitive personal data, such as personal data disclosing racial or ethnic origin, religion, trade union membership, sexual orientation, health data, etc. If, in exceptional cases, the performance of a job places special demands on your health, we will – based on a specific assessment – ask for your consent to the processing of such personal data, cf. Article 6(1)(a) and Article 9(2)(a) of the GDPR.

If you are offered a job with VOLA, your application and other relevant personal data collected in connection with the recruitment procedure will be stored in your personal folder with us.

If you are not offered a job, we will store your application and any other personal data collected in connection with the recruitment procedure for a period of 6 months following our rejection of your application, unless you have consented to storage of such personal data for a longer period of time. In the course of the first 5 months, you will be asked whether you wish to consent to us storing your application for a longer period of time. If you have applied for a job with our company in the Netherlands, your application will, however, be deleted after 4 weeks, unless you have given your consent to storage for a longer period.

You may at all times withdraw any consent you may have given as part of our recruitment procedure. Withdrawing your consent will affect the future processing of your personal data, but it will not affect the legitimacy of the processing that took place based on your consent given prior to such withdrawal. You have a right of access to the personal data we process about you, however, subject to certain statutory exceptions. You are also entitled to object to the collection and further processing of your personal data. In addition, you have the right to request that the processing of your personal data be restricted, that your personal data be rectified, and also made complete, if necessary, or that your personal data be deleted under certain circumstances.

In certain situations, you may also request that we provide you with a copy of your personal data in a structured, commonly used and machine-readable format and request us to transmit such personal data which you have provided us with to another data controller.
